1. Acceptance of Terms

By accessing or using the Cold Lake Guide application, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access the app.

2. User Accounts

You must provide accurate information when creating an account. You are responsible for safeguarding the password and for all activities that occur under your account.

3. Business Listings, Content & Removal Rights

Users who submit businesses, events, or jobs must have the right to do so. You acknowledge that any business information you submit for a listing is public information intended for public distribution within the app.

We reserve the right, at our sole discretion, to immediately remove and delete any information, listing, or account without prior notice if it violates these Terms of Service, or if we determine the information is being used to lie, mislead, or trick the public.

4. Advertising, Featured Placements & Payments

All payments for featured placements and advertising are processed securely through Stripe. We do not collect or store your credit card information. All fees are non-refundable unless otherwise required by law.

Advertising Liability Limitation: If your paid advertisement is not displayed as agreed due to app downtime, removal of the app from the Apple App Store or Google Play Store for any reason, or any other disruption of service, our sole responsibility and maximum liability to you is strictly limited to a refund of the actual money you paid to us for the unfulfilled duration of the advertisement. We are not liable for any lost profits or indirect damages resulting from the unavailability of your advertisement.

5. Fraud & Misuse Disclaimer

We are a directory service and do not vet every transaction or interaction that occurs as a result of using the app. We are not liable for any incorrect use of the application, nor are we responsible for any fraud, scams, or deceptive practices committed by users, third parties, or businesses listed within the app. You agree to interact with listed businesses and users at your own risk.

6. Disclaimer of Warranties

THE APP AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cold Lake Guide, its creators, affiliates, or agents be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or relating to the use of the application. Under no circumstances will we be responsible for any damage, loss, or injury resulting from hacking, tampering, data breaches, or other unauthorized access.

8. Indemnification

You agree to defend, indemnify, and hold harmless Cold Lake Guide from and against any claims, damages, losses, liabilities, costs, or debt (including attorney’s fees) arising from: (i) your use of the app; (ii) your violation of these Terms; (iii) your violation of any third-party right; or (iv) any claim that your business listing or content caused damage to a third party.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of the app constitutes acceptance of the new terms.
